What this is all about – introduction to our terms and conditions

2.1 These are our terms and conditions which apply when you buy a EV Charger, Battery or Solar PV system from us. (Separate terms apply to use of our site.) We’ve tried to make them user-friendly. Please read them carefully and save a copy as we don’t file a copy specifically for the transaction with you. They are available in English only.

Consumers – definition and minimum legal rights:

3.1 Where we refer to “Consumer” below we mean an individual acting for purposes which are wholly or mainly outside that person’s trade, business, craft or profession.

3.2 We are legally required to remind Consumers that we are under a legal duty to supply goods that are in conformity with the contract. Furthermore, nothing below affects Consumers’ legal rights in relation to goods that are not in conformity with the contract, whether because they are faulty, not as described or otherwise. You can get advice about your legal rights from your local Trading Standards office or Citizens’ Advice Bureau.

3.3 It is the consumers responsibility to check the T&Cs available on your website and agree to them at time of work commencing.

Your obligations:

4.1 You must ensure that all information you supply to us in connection with your order is correct and complete and that you tell us immediately if there are any changes.

4.2 You promise to comply promptly with our reasonable requests for information and to generally provide us with reasonable co-operation in relation to our supply of goods / services to you.

Forming a contract with us:

5.1 There is a binding legal contract between us when you confirm the installation with EV-PV Ltd.

5.2 The contract shall be governed by and construed in accordance with the laws of England & Wales and shall be subject o the jurisdiction of the courts of England & Wales.

Price and payment

6.1 The price is as stated in the order summary estimate.

6.2 Any applicable VAT or sales tax is included in any price shown.

6.3 Installation quotes expire after the period stated in the quote. Quotes are valid as stated in the estimate.

6.4 You must make the relevant payments within the relevant payment periods stated in the quote and using one of the payment methods stated prior to installation. The contract ends automatically if we do not receive full payment in cleared funds within any applicable payment period.

6.5 You authorise us and our third-party payment provider to take payment and/or to charge your payment card for the relevant amounts and at the relevant times. It is your responsibility to update your payment card details as necessary.

6.6 For installation quotes, if we have mis-priced the quote by mistake or incorrect information provided, we are not obliged to supply and install the charger at that price provided we tell you before installation. If we do, then you can decide if you want to continue with the order at the right price but, if you do not, we will provide a full refund of any payments already made.

6.7 You must contact us as soon as reasonably practical with full details if you dispute any payment.

6.8 If any amount due to us is unpaid, or unjustifiably charged back, we may end or suspend this agreement on email notice.

6.9 Some invoices are issued after the installation has been completed. these invoices are due upon receipt. Any late payments will incur a 10% a monthly late payment fee. We will start small claims court proceedings 7 days after the 60 days and will add all interest and admin fees. Interest amount is calculated by the small claims court calculator at the time of writing, 0.08%.

Fees are as followed: fixed fee £40 for debts under £1,000, £70 for £1,000–£9,999, and £100 for £10,000 or more.

You will also be charged any other admin costs for example: Postal charges etc

Delivery

7.1 Unless otherwise stated, delivery dates or periods given on our website are estimates only. We have no liability for any losses arising from delay in delivery if caused by circumstances beyond our reasonable control or by your failure to supply adequate delivery instructions.

7.2 If you receive notification of an unsuccessful attempted delivery, it is your responsibility to contact the courier to arrange re-delivery. If nobody is available to receive the goods, we may leave them at the doorstep, reception, or with a neighbour.

7.3 If the goods are undelivered due to your failure to comply with the contract (e.g. incorrect delivery address, unpaid import charges, failure to contact courier), and they are returned to us, you are responsible for return costs and any restocking fees. We may require such costs to be paid before arranging re-delivery or may deduct them from any refund due.

Installation

8.1 Once we receive full payment (or a deposit if paying in instalments), we will notify your Distribution Network Operator (DNO) within 28 days of installation. If prior DNO approval is required, we will inform you.

8.2 The DNO may need to visit your property and charge for any necessary works. These charges are outside EV-PV Ltd’s control.

8.3 EV-PV Ltd provides a one-year workmanship warranty. All charge points and solar products come with a manufacturer warranty. Customers who supply their own charger must deal with any charger related warranty issues themselves. We are not obliged to carry out the warranty work when the charger is at fault. Our standard charges would apply to fix the charger.

8.4 We agree to provide installation services with reasonable care and skill.

8.5 You must provide access to our installers and ensure a safe work environment. We are not liable for damage caused by moving items.

8.6 A responsible adult must be present on installation day. If post-installation modifications are requested after sign-off, additional charges may apply.

8.7 We may cancel installation if the site is unsuitable and refund your payment, unless the issue could have been identified via a proper site survey—in which case a deduction may apply.

8.8 We are not responsible for delays requiring multiple visits or rescheduling.

Grant

9.1 If applying for a Government grant, we will deduct it from your invoice if you are eligible. We will claim the grant on your behalf post-installation. If your grant is rejected, you must pay the deducted amount (typically £350) within 7 days.

9.2 If you fail to pay the grant shortfall, we retain ownership of the charger and may deactivate or remove it. You must provide access to facilitate this. This does not affect our legal rights.

Ownership and use of equipment

10.1 All equipment installed remains the property of EV-PV Ltd until the invoice is settled in full, including any rejected grant amounts. Once paid in full, ownership transfers to you.

10.2 You are responsible for proper use and maintenance of the equipment, in accordance with manufacturer guidelines and applicable laws. Unauthorised modifications may void warranties.

Consumer right to cancel (“cooling off”)

11.1 Consumers have the legal right to cancel this contract within 14 days of receiving the goods.

11.2 If we begin services before the end of the cancellation period (e.g., applying for grants or DNO approval), an administration fee of £55 will apply if you cancel.

Manufacturer guarantees 12.1 Products may be covered by a manufacturer’s warranty. Refer to the product documentation. 12.2 This does not affect your consumer rights.

 

Liability

13.1    Nothing in this agreement in any way limits or excludes our liability for negligence causing death or personal injury or for fraud or fraudulent misrepresentation or for anything which may not legally be excluded or limited. In this section, any reference to us includes our employees and agents.

13.2 For Consumers, we are not liable for:

unforeseeable losses,

losses caused by your own breach,

business-related losses.

13.3 For non-Consumers: a) Liability is capped at the price paid. b) We are not liable for indirect or consequential losses. c) You indemnify us against losses due to your breach. d) This agreement is the entire understanding between us.

Events outside our control

14.1 We are not liable for delays caused by events beyond our reasonable control.

Your personal information

15.1 We process your data according to our privacy policy.

Governing law

16.1 This agreement is governed by English law and disputes will be resolved in the UK courts.

General

17.1 We may send notices to your email. If any part of this agreement is found invalid, the rest will still apply. We may transfer our rights and obligations under this agreement.

Complaints

18.1 For complaints, please contact us. We aim to respond within 5 working days. If unresolved, you may escalate your complaint to Dispute Resolution Ombudsman via Which? Trusted Traders (0117 456 6031).
